These Terms and Conditions govern the use of the website and the purchase of products offered by Arte del Tempo S.r.l, registered at Via Gramsci 25, 43036 Fidenza (PR), VAT/Tax No. 02873970343, email rrubiniorologi@gmail.com (hereinafter "Seller" or "we"). Please read them carefully before making a purchase.
1. Acceptance of Terms
By using this website or placing an order, you confirm that you have read, understood and fully accepted these Terms and Conditions and our Privacy Policy. If you do not accept these terms, please do not use our service.
2. Eligibility
To make purchases on this site you must be at least 18 years old and have full legal capacity to act. By purchasing products you confirm that you meet these requirements. The Seller reserves the right to cancel orders if doubts arise about the customer's capacity to contract.
3. Service Description
We offer an e-commerce service specialising in the sale of new and pre-owned luxury watches. Our services include:
- Sale of new watches with manufacturer's international warranty
- Sale of certified pre-owned watches inspected by our experts
- Trade-In service: valuation and purchase of pre-owned watches
- After-sales support, technical assistance and warranty service
4. Account Registration
To make purchases you must create an account providing accurate, complete and up-to-date information. You are responsible for the confidentiality of your login credentials and all activity conducted through your account. 5. Orders and Payments
5.1 Order Process
Orders placed through the site constitute purchase proposals. The contract is concluded upon the order confirmation email sent by the Seller. We reserve the right to decline an order in case of: out-of-stock items, pricing errors, unverifiable information or fraud signals.
5.2 Prices
All prices are expressed in Euros (€) and include VAT where applicable. Prices of pre-owned and some luxury watches may vary according to market fluctuations. The applicable price is that shown at the time of order confirmation.
5.3 Payment Methods
Online payments are processed securely by Stripe Inc. We accept major credit and debit cards (Visa, Mastercard, American Express) and other payment methods enabled by the Stripe platform. Some high-value products may only be purchased by contacting our staff directly ("contact to purchase" mode), with payment to be agreed separately.
6. Shipping and Delivery
Shipping takes place within 1–3 business days of payment confirmation. Estimated delivery times are:
- Italy: 1–2 business days
- Europe: 3–5 business days
- Rest of the world: 5–10 business days
All watches are shipped in secure, discreet packaging. For international shipments the customer is responsible for any customs duties, import taxes and other charges applicable in the destination country.
6.1 Shipping Insurance and Security
All luxury product orders are shipped via insured express courier for the full value of the product. We track every shipment and will provide you with a tracking code. Risk passes to the customer upon signed delivery. In case of damage or loss in transit, contact us within 48 hours of delivery (or the expected delivery date) to initiate the courier reimbursement process.
7. Right of Withdrawal
Under Arts. 52 et seq. of the Italian Consumer Code (Legislative Decree 206/2005), you have the right to withdraw from the contract within 14 days of receiving the product, without providing any reason. To exercise the right of withdrawal, send an explicit declaration (e.g. by email to rrubiniorologi@gmail.com) before the 14-day deadline expires.
The product must be returned within 14 days of notifying withdrawal, in original condition, complete with all accessories, certificates, original box and documentation. Return shipping costs are borne by the customer unless otherwise agreed. Reimbursement will be made within 14 days of receipt of the returned product, using the same payment method used for the purchase.
8. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply in the following cases (Art. 59 Consumer Code):
- Products customised or made to order according to the customer's specifications
- Products whose value depends on fluctuations in the financial market beyond the Seller's control
- Products returned showing obvious signs of use, damage, or missing original components
9. Statutory Conformity Warranty
Under Arts. 128 et seq. of the Italian Consumer Code (Legislative Decree 206/2005), all products sold to consumers are covered by a statutory conformity warranty of 2 years from the date of delivery. In the event of a conformity defect, you are entitled to repair, replacement, a price reduction or contract termination.
10. Seller's Warranty
In addition to the statutory warranty, we offer the following commercial warranties:
- New watches: international manufacturer's warranty (generally 2 years, varies by brand)
- Certified pre-owned watches: 1-year commercial warranty from the Seller, covering movement defects
The warranty does not cover damage from misuse, impact, drops, liquid contact (except water-resistant watches), unauthorised servicing or normal cosmetic wear.
11. Authenticity and Certification
We guarantee the authenticity of all products sold. Each pre-owned watch undergoes a rigorous verification process by our expert watchmakers, including: full visual inspection, serial number verification, movement check and authenticity certification. Each sale is accompanied by documentation attesting to the product's authenticity.
12. Trade-In Service
The Trade-In service allows you to request a valuation and sale of your pre-owned watch. The valuation is free and non-binding. Once the trade-in value is agreed, payment is made directly according to the terms agreed with our staff.
The final valuation is subject to physical inspection of the product at our store. The Seller reserves the right to modify or withdraw the offer following inspection if the actual condition does not match what the customer declared.
13. Limitation of Liability
To the extent permitted by applicable law, the Seller's liability to the customer is limited to the value of the product purchased. We are not liable for indirect, consequential damages or loss of profit, except in cases of wilful misconduct or gross negligence. Nothing in these Terms excludes or limits the consumer's mandatory statutory rights under the Consumer Code.
14. Intellectual Property
All site content — texts, images, logos, design, videos and graphic materials — is the exclusive property of the Seller or its respective rights holders and is protected by copyright and trademark law. Any reproduction, distribution or commercial use without express written authorisation is prohibited.
15. Force Majeure
The Seller is not liable for delays or non-performance caused by force majeure events, including but not limited to: natural disasters, pandemics, strikes, third-party service outages, public authority measures or other events beyond the Seller's reasonable control.
16. Dispute Resolution
In the event of a dispute, we invite you to contact us first at rrubiniorologi@gmail.com for an amicable resolution. Under Italian Legislative Decree 206/2005, consumers may resort to Alternative Dispute Resolution (ADR) procedures. For information on accredited ADR bodies in Italy, please consult the Italian Competition Authority (AGCM) website at www.agcm.it.
17. Governing Law and Jurisdiction
These Terms and Conditions are governed by Italian law. For consumers, the competent court is that of the consumer's place of residence or elected domicile in Italy, pursuant to Art. 66-bis of the Consumer Code. For non-consumer (B2B) customers, the exclusive jurisdiction is the court of Parma, excluding all other courts.
18. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will take effect from the date of publication on the site. For orders already confirmed, the terms in force at the time of purchase continue to apply. We recommend checking this page periodically.
